Shivers pleads guilty to 2021 robbery | News, Sports, Jobs – Fort Dodge Messenger

A Fort Dodge man pleaded guilty Monday to his role in a January 2021 armed robbery in the Coleman District.
Davaris Jamel Shivers, 18, pleaded guilty to an amended charge of second-degree robbery, a Class C felony, and one count of possession of a firearm by a prohibited person, a Class D felony.
In accordance with his plea agreement with the Webster County Attorney’s Office, the remaining counts — going armed with intent, first-degree burglary and carrying weapons — were dismissed.
According to court documents, Shivers and two other men forced their way into an apartment in the 2000 block of South 12th Street around 8 a.m. on Jan. 4, 2021, with the intent to rob the occupants. During the robbery, one of the other men involved shot at a resident of the apartment, Benjamin Myer, hitting him in the abdomen. The suspects fled the scene, leading Webster County Sheriff’s Office deputies on a short pursuit.
Co-defendants Tyler Rosburg and Ashton Lomicka accepted plea deals in October.
Rosburg, 29, pleaded guilty to one count of first-degree robbery, a Class B felony; one count of possession of a firearm as a felon, a Class D felony; and one count of eluding, a serious misdemeanor. He has been sentenced to up to 25 years in prison with a mandatory minimum of 50%.
Lomicka, 23, pleaded guilty to one count of second-degree robbery. He was sentenced to up to 10 years in prison, with a mandatory minimum of 70%.
A sentencing hearing for Shivers has not yet been set. He faces up to 10 years in prison for the second-degree robbery charge and up to five years in prison for the firearm possession charge.
